Terms of use
These terms govern the use of KLAUSUR.AT. By creating or joining a session you agree to them. They are deliberately short. This is a translation; the German version is legally binding.
1. Provider
KLAUSUR.AT is operated by Philip P.M. Jansohn, sole proprietor, Canettistraße 1 / 1201, 1100 Wien, Austria, email: [email protected] (“the operator of the web service”). Further details are in the imprint.
2. Service
KLAUSUR.AT is a free online tool for workshops, strategy retreats and meetings. Facilitators can create a digital session room without signing up; participants join via code, link or QR code. Features include idea collection, voting, prioritisation, decisions, action plan, pulse check, parking lot, timer, presentation mode and export as PDF and CSV.
The service is free of charge. There is no entitlement to any particular feature, to constant availability or to the continuation of the service. The operator of the web service may change, extend or discontinue features to the extent this is reasonable for you.
3. Roles and access
- Facilitator: Whoever creates a session receives a protected facilitator link. Anyone with this link has full facilitator rights, including deleting the session. Keep it safe and share it only with people who are meant to facilitate. A lost facilitator link cannot be recovered.
- Participants: Participants join with the six-digit code, the invitation link or the QR code. Anyone who knows the code can join – so only share it with the intended group.
- The facilitator is responsible for their session: they decide who is invited and what content is recorded. If KLAUSUR.AT is used on behalf of a company, the facilitator informs participants about its use.
4. Acceptable use
When using KLAUSUR.AT, you must not
- post unlawful, offensive, discriminatory, threatening or otherwise objectionable content,
- infringe the rights of others, such as copyright, trademark or personality rights,
- enter special categories of personal data (e.g. health data) or confidential personnel matters,
- distribute advertising, spam or malware,
- guess codes, circumvent security measures, query the website automatically at scale or otherwise disrupt its operation.
In the event of violations, the operator of the web service may delete the content or sessions concerned without notice and block access.
5. Your content
The content you enter in a session remains yours. You merely grant the operator of the web service the right to store it and display it to the participants of that session, as far as this is necessary to operate the service. The operator of the web service does not routinely review content and does not adopt it as its own. Those who enter content are responsible for it. If the operator of the web service becomes aware of unlawful content, it will be removed promptly.
6. Retention and backups
Every session is deleted automatically and completely 30 days after it was created; the facilitator can delete it immediately at any time. Deleted sessions cannot be restored and no backups are kept for you. Please save important results yourself in good time, for example via the PDF report or the CSV export.
7. Availability
The operator of the web service strives for uninterrupted operation but cannot guarantee constant availability. Maintenance, technical faults or events beyond the operator's control may temporarily restrict use. Please do not rely solely on KLAUSUR.AT for important appointments.
8. Liability
KLAUSUR.AT is provided free of charge. The operator of the web service is only liable for damage caused intentionally or through gross negligence. This limitation does not apply to personal injury or where liability is mandatory by law. For the loss of content, in particular after the retention period has expired or after deletion by the facilitator, the operator of the web service is only liable to the extent stated. Users alone are responsible for decisions made on the basis of results from KLAUSUR.AT.
9. Privacy
How personal data is processed is explained in the privacy policy.
10. Changes to these terms
The operator of the web service may amend these terms for the future, for example if the service or the law changes. The version published here at the time of use applies. As no user accounts are kept, an amended version applies to sessions created or joined after its publication.
11. Applicable law and jurisdiction
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country in which they habitually reside. The place of jurisdiction for businesses is Vienna. For consumers, the statutory places of jurisdiction apply.
12. Final provisions
Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected.
